The Website is directed to customers in the United States. We may decline to accept an order from, or ship to, any territory where we do not operate, where the product is not authorised, or where applicable export or sanctions law prohibits it.
4. PERMITTED USE
You may browse the Website, place orders, and download or print content for your own personal, non-commercial use. Everything else requires our prior written permission.
You agree not to:
- use the Website for any unlawful purpose, or in breach of these Terms;
- copy, reproduce, republish, sell, or exploit any part of the Website commercially;
- use any robot, scraper, or automated means to access, monitor, or copy the Website or its content, except for search engine crawlers respecting our robots directives;
- circumvent, disable, or interfere with security features, rate limits, or access controls;
- introduce malware, or attempt to gain unauthorised access to any system, account, or data;
- impose an unreasonable load on our infrastructure, including through denial-of-service or automated ordering;
- submit false, misleading, or fraudulent information, including in an order or a review;
- use our trade marks, logos, or brand name in a way likely to cause confusion, including in advertising, domain names, or social media handles, without our written permission.
We may suspend or terminate your access to the Website at any time, without notice, if we reasonably believe you have breached this section.
5. INTELLECTUAL PROPERTY
All content on the Website — text, graphics, photographs, video, logos, the Geotag name and word mark, page layouts, and software — is owned by us or by our licensors and is protected by copyright, trade mark, and other intellectual property laws.
No licence is granted except the limited permission described in section 4. All rights not expressly granted are reserved.
If you believe content on the Website infringes your copyright, send a notice under the Digital Millennium Copyright Act to the contact address in section 15, including: identification of the work; identification of the material and its location; your contact details; a statement of good-faith belief that the use is unauthorised; a statement, under penalty of perjury, that the notice is accurate and that you are authorised to act; and your signature. We remove or disable infringing material and terminate repeat infringers.
6. YOUR CONTENT, REVIEWS, AND FEEDBACK
If you submit a review, comment, photograph, question, or any other content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, and sublicensable licence to use, reproduce, adapt, publish, and display it in connection with our business, including in advertising. You waive any moral rights to the extent permitted by law.
You confirm that you own the content or have the right to grant that licence, and that it does not infringe anyone’s rights or break any law.
We do not offer, request, or accept any incentive in exchange for a positive review, and we do not suppress or edit negative reviews to distort the overall rating. We may remove content that is unlawful, abusive, off-topic, or fake.
Any suggestion or idea you send us may be used without restriction, acknowledgement, or compensation.
7. PRODUCT INFORMATION AND ACCURACY
We take care to describe our products accurately, but we do not warrant that descriptions, images, specifications, pricing, or availability are error-free, complete, or current. Colours and dimensions may appear differently depending on your screen.
Battery life, range, and connectivity figures are indicative and depend on conditions of use, including device compatibility, obstacles, interference, and network coverage.
We may correct any error, and may change or discontinue a product at any time. The consequences of an error affecting an order you have already placed are set out in the Terms of Sale.
8. THIRD-PARTY LINKS AND SERVICES
The Website links to services we do not control, including payment providers, carriers, tracking pages, and social platforms. We provide those links for convenience. We are not responsible for their content, availability, or practices, and their own terms and privacy policies apply.
9. DISCLAIMERS
The Website is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and we do not warrant that the Website will be uninterrupted, timely, secure, or error-free.
Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under applicable law, including the statutory rights of consumers. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
This section concerns the Website. Warranties applying to the products themselves are set out in the Terms of Sale.
10. LIMITATION OF LIABILITY
To the fullest extent permitted by law, we and our officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Website, even if we have been advised of the possibility.
Our total aggregate liability arising out of or relating to the Website, whether in contract, tort, or otherwise, will not exceed the greater of the amount you paid us in the twelve months preceding the event giving rise to the claim, or one hundred United States dollars (USD 100).
These limits do not apply to liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or to any liability that cannot lawfully be limited. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
11. INDEMNIFICATION
You agree to indemnify and hold us harmless from any claim, loss, liability, and reasonable legal fees arising out of your breach of these Terms, your misuse of the Website, your content, or your violation of any law or third-party right. We may assume the exclusive defence of any matter subject to indemnification by you, and you agree to cooperate.
12. DISPUTE RESOLUTION, ARBITRATION, AND CLASS ACTION WAIVER
Please read this section carefully. It affects your legal rights.
Informal resolution first. Before starting any proceeding, you agree to contact us and give us 30 days to resolve the dispute informally. Most matters are settled at this stage.
Binding arbitration. If the dispute is not resolved, it will be settled by binding individual arbitration administered in the United States under the rules of a recognised arbitration provider, rather than in court, except that either party may bring an individual claim in small-claims court. The arbitration will take place in the State of Wyoming or, at your election, in the county where you reside, or by telephone or written submission.
Class action waiver. Disputes will be arbitrated only on an individual basis. You and we waive any right to bring or participate in a class, collective, consolidated, or representative action. If this waiver is held unenforceable as to a particular claim, that claim proceeds in court and the remainder stays in arbitration.
Your right to opt out. You may reject this arbitration agreement by sending written notice to support@trygeotag.com within 30 days of your first purchase, clearly stating your name, order number, and your intent to opt out. Opting out does not affect any other part of these Terms, and we will not treat it to your disadvantage.
Time limit. Any claim must be brought within one year after it arises, or it is permanently barred, unless applicable law provides otherwise.
If you are a consumer resident in the European Economic Area or the United Kingdom, this section does not deprive you of the protection of the mandatory consumer law of your country of residence, nor of the right to bring proceedings before the courts of that country.
13. GOVERNING LAW
These Terms are governed by the laws of the State of Wyoming and the federal law of the United States, without regard to conflict-of-law rules. Subject to section 12, the state and federal courts located in that State have exclusive jurisdiction, and you consent to their jurisdiction and venue.
If you are a consumer resident elsewhere, you keep the benefit of any mandatory provision of the law of your country of residence that cannot be derogated from by agreement.
14. GENERAL
- Changes. We may amend these Terms. The version published on the Website when you use it is the version that applies, and the “Last updated” date shows when it changed. Continued use after a change means acceptance.
- Severability. If a provision is held unenforceable, it is limited or removed to the minimum extent necessary and the remainder stays in force.
- No waiver. A failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure. Neither party is liable for a failure to perform caused by an event beyond its reasonable control.
- Entire agreement. These Terms, together with the Terms of Sale, the Privacy Policy, and the Cookie Policy, form the entire agreement between you and us regarding the Website.
